State Asks Court for Injunction Prohibiting Ft. Dodge Tire Facility from Accepting More Waste Tires

FORT DODGE-- The Attorney General's Office filed an application today in Webster County District Court asking the Court to issue a temporary injunction barring Dodger Enterprise Co., Tire Chop, Inc., and Donald Grell from accepting any more waste tires at their storage and processing facility in Fort Dodge.
A lawsuit filed August 25 by the Attorney General alleged that the facility had at least 1.2 million tires and was in violation of its operating permit, state environmental regulations, and fire code requirements.

On September 21, the State Environmental Protection Commission affirmed action by the Dept. of Natural Resources to revoke the defendants' solid waste permit and deny their application for a new waste tire management permit. The EPC action cleared the way for the Attorney General's Office to ask the Court to issue a temporary injunction barring the defendants from accepting more tires while the lawsuit proceeds, and ordering the defendants to remove and properly dispose of all accumulated tires at the site.
