Trial Information Filed Naming Pierre Pierce

Adel. Dallas County Attorney Wayne Reisetter and Assistant Attorneys General Patricia Houlihan and Scott Brown filed a Trial Information today in Dallas County District Court in Adel. The Trial Information formally charges Pierre Antoine Pierce with the following crimes:

Count 1: Burglary in the first degree, a Class B felony, in violation of Sections 713.1 and 713.3 of the Code of Iowa.

Count 2: Burglary in the first degree, a Class B felony, in violation of Sections 713.1 and 713.3 of the Code of Iowa.

Count 3: Assault with intent to commit sexual abuse, a Class D felony, in violation of Sections 709.11 and 708.1 of the Code of Iowa.

Count 4: Criminal mischief in the fourth degree, a serious misdemeanor, in violation of Sections 716.1 and 716.6 of the Code of Iowa.

The Class B felonies are punishable by up to 25 years in prison. The Class D felony is punishable by up to five years in prison and a fine of $750 to $7500. The serious misdemeanor is punishable by up to one year in jail and a fine of $250 to $1500.

District Court Judge Gregory Hulse set arraignment for March 4, 2005, at 8 a.m.

Pierce was arrested February 9, 2005, and released Feb. 9 on pretrial release through the Dept. of Correctional Services.

The Attorney General's Office, which includes a Violence Against Women prosecution unit, is providing additional prosecution resources at the request of the Dallas County Attorney.

COUNT 1: BURGLARY IN THE FIRST DEGREE, A CLASS B FELONY, committed as follows: On or about January 27, 2005, in the City of West Des Moines, County of Dallas and State of Iowa, the Defendant did commit a burglary upon the motor vehicle of another person and did during the course thereof intentionally or recklessly inflict physical injury on another person in violation of Sections 713.1 and 713.3 of the Code of Iowa.

COUNT 2: BURGLARY IN THE FIRST DEGREE, A CLASS B FELONY, committed as follows: On or about January 27, 2005, in the City of West Des Moines, County of Dallas and State of Iowa, the Defendant did commit a burglary upon the residence of another person located at 277 South 79th Street, #704, West Des Moines, Iowa and during the course thereof possessed a dangerous weapon, or did intentionally or recklessly inflict physical injury on another person, in violation of Sections 713.1 and 713.3 of the Code of Iowa.

COUNT 3: ASSAULT WITH INTENT TO COMMIT SEXUAL ABUSE, A CLASS D FELONY, committed as follows: On or about January 27, 2005, in the City of West Des Moines, County of Dallas and State of Iowa, the Defendant did commit an assault against Jane Doe with the intent to commit sexual abuse and thereby caused bodily injury in violation of Sections 709.11 and 708.1 of the Code of Iowa.

COUNT 4: CRIMINAL MISCHIEF IN THE FOURTH DEGREE, A SERIOUS MISDEMEANOR, committed as follows: On or about January 27-28, 2005, in the City of West Des Moines, County of Dallas and State of Iowa, the Defendant did commit criminal mischief upon the property of another person without the right to do so which resulted in costs in excess of two hundred dollars but less than five hundred dollars to replace, repair, or restoring the damaged property, in violation of Sections 716.1 and 716.6 of the Iowa Code.
