Miller Hails “Private Right of Action”
Comment by Attorney General Tom Miller as Governor Chet Culver signs important consumer protection legislation:
Statement by Iowa Attorney General Tom Miller:
This is a very important day for Iowa consumers. This new law creates a private right of legal action for Iowans who are victims of consumer fraud. Iowans now finally join the citizens of every other state in having the important right to be able to go to court to protect their rights as consumers.
This bill gives protections to older Iowans, and to all consumers who might be cheated when they buy used cars, contract for home repairs, or get a home mortgage.
In addition to helping Iowa consumers, this law will benefit the vast majority of Iowa businesses. Businesses that play by the rules should not face unfair competition from businesses that would use fraudulent practices.
We have worked on passing this measure for many years and we thank the Governor, legislators, AARP members, and others who made its passage possible. I especially am grateful to Rep. Kurt Swaim for his dedication and persistence in guiding this legislation to passage by the House Judiciary Committee.
