Rule Changes 1999


Chapter 1 adds new subrules 1.23(5), 1.23(6), 1.42(10) and 1.42(11) to clarify that licensees that are not a party to the listing agreement or brokerage agreement are prohibited from interfering with contracts between other licensees and the public.

Chapters 4 "Investigations and Disciplinary Procedures" is rescinded and replaced by new a chapter 4 which implements changes to of 1998 Iowa Acts, chapter 1202 .

Chapter 7 "Declaratory Rulings" is rescinded and replaced by a new chapter 7 "Declaratory Orders" which implements changes to model rules as required by administrative procedure act as a result of 1998 Iowa Acts, chapter 1202 as well.


Chapter 3, "Prelicense Education and Continuing Education" amemdments establish specific guidelines for approval of live classroom courses, distance education courses and home-study courses. Other amendments are for purposes of removing dates that have passed. An additional amendment clarifies that non-resident broker and broker associates and licensees who qualify under 2.3 or obtain a reciprocal license shall complete the brokerage management courses on a one-time-only basis, at the time of the licensee’s first Iowa renewal, unless there is a reciprocal education agreement between the states.
