Present: Russ Nading, Chair; Terry Rogers, Evelyn Rank, and Theresa Loffredo.
Mark Odden was absent. Others present: Roger Halvorson,
Administrator; Roger Hansen, Executive Secretary; Pam Griebel,
Assistant Attorney General; Michael Sharp, and Chris Wood, Secretary.
The meeting was called to order by Nading at 9:00 a.m.
Rogers moved, seconded by Rank that the Commission enter into
closed session pursuant to Iowa Code section 21.5(1)(d)(f). Roll
call vote as follows: Loffredo, aye; Rank, aye; Rogers, aye and
Nading, aye. Motion carried. The closed session was tape recorded
and minutes were recorded. The Commission entered into closed session
at 9:01 a.m. and arose therefrom at 9:15 a.m.
Rogers moved, seconded by Rank to accept the Informal Settlements
for Cases A97-066, 97-043, and A96-111. Roll call vote as follows:
Loffredo, aye; Rank, aye; Rogers, aye and Nading, aye. Motion carried
unanimously.
Loffredo moved, seconded by Rogers to close the following complaint
cases:
97-059 97-103 97-076 97-064 97-081 97-082
97-092 97-070 97-020 97-089 97-071 97-075
97-084 97-085 97-086 97-098
and to find probable cause on the following cases:
97-015 A97-055 97-102
Motion carried unanimously.
Loffredo moved, seconded byRogers to approve the August 21, 1997,
minutes as submitted. Motion carried unanimously.
The December meeting will be a one day meeting on December 11,
1997, depending on the number of complaint cases.
Rogers moved, seconded by Rank to deny the request of Bruce E.
Barks. Motion carried unanimously.
Rogers moved, seconded by Rank to deny the request of Patricia
McAfoos. Motion carried unanimously.
Loffredo moved, seconded by Rogers to deny the request of Charla
Dickinson. Motion carried unanimously.
Loffredo and Odden attended the UNI Advisory Council meeting October
8, 1997. The real estate program is scheduled to be approved for
a minor degree.
Rank has been appointed to the Legal and Professional Conduct
Committee of ARELLO.
Nading was choosen to meet with the Iowa Association of Realtors
with 24 brokers from around the state to review proposed legislation.
Halvorson reported as of July 1, 1997, the interest from the trust
accounts was now going to the Department of Economic Development.
He announced the Board Chairs meeting is scheduled for November
24, 1997, and the next Newsletter will be out January l, 1998.
Sharp distributed a written audit report. There have been 135
desk audits completed since May 1, 1997.
Hansen reported an excellent ARELLO meeting in Maui. He is serving
as Chair of the Interjurisdiction Cooperation Committee and on
the International Task Force sub-committee. The Commission meeting
schedule, minutes, discipline, and education providers are now
on the Internet with links to federal agencies.
Griebel reported Texas has struck out a law requiring interest
on attorney trust accounts. She has written a Newsletter article
on confidentiality and the rights of licensees when disciplinary
action is being taken.
Rogers moved, seconded by Loffredo to accept the following subdivided
land renewals and abbreviated timeshare filing:

Motion carried unanimously.
On
the advice of the Attorney General, only the agency disclosure
forms will be updated.
Loffredo moved, seconded by Rank to adjourn the meeting at 10:37
a.m.
