22, 1999--MINUTES
Present: Chair Terry Rogers, Russ Nading, Theresa Loffredo, Evelyn Rank,
and Mark Odden.
Others
present: Roger Halvorson, Administrator; Roger Hansen,
Executive Secretary; Pam Griebel, Assistant Attorney General; Susan
Griffel, Education Director; Frank Hansen, Field Auditor; LuAnn
Julstrom, staff.
The meeting was called to order by Rogers at 9:00 a.m.
Theresa Loffredo and Mark Odden, who are leaving the Commission,
were given plaques in recognition of their service.
Odden moved, seconded by Loffredo, that the Commission enter into
closed session pursuant to Iowa Code section 21.5(1)(d) and Iowa
Code 21.5(1)(f). Roll call vote as follows: Rogers, aye; Nading,
aye; Rank, aye; Loffredo, aye: Odden, aye. Motion carried. The
closed session was tape recorded and minutes were recorded. The
Commission entered into closed session at 9:05 and arose therefrom
at 9:26 a.m.. Contested cases and disciplinary cases were discussed
At 9:07 a.m. Hansen and Griebel left the closed session while
cases were being discussed for which they had been involved in
the hearings. Bill Schroeder joined the closed session. Cases 97-113,
97-102, and 97-041 were discussed. Schroeder left the closed session
and Hansen and Griebel rejoined the closed session at 9:12 a.m.
Nading moved, seconded by Rank, that the Commission enter into
closed session pursuant to Iowa Code section 21.5(1)(a). Roll call
vote as follows: Rogers, aye; Nading, aye; Rank, aye; Loffredo,
aye; Odden, aye. Motion carried. The closed session was tape recorded
and minutes were recorded. The Commission entered into closed session
at 9:27 a.m. and arose therefrom at 9:31 a.m.. Criminal information
was discussed concerning an applicant; this information must be
kept confidential pursuant to Iowa Code section 543(B).52(1).
Odden moved, seconded by Loffredo, to accept the proposed decisions
and orders for cases 97-113, 97-102, 97-041. Motion carried.
Odden moved, seconded by Loffredo, to find probable cause in cases
98-075, 99-036, A99-001, A99-002, 99-027, and 98-033. Motion carried.
Odden moved, seconded by Rank, to close cases 98-081, 98-079,
98-086, 98-100, 99-022, 99-005, 99-006, A99-004, and 99-012. Motion
carried.
Odden moved, seconded by Nading, to grant license to applicant
Johannsen.
Motion carried.
Odden moved, seconded by Loffredo, to approve the minutes of the
January 28 and February 23 meetings. Motion carried.
The schedule of meetings through the end of 1999 was discussed.
The Investigative Committee for May 1999 is Nading and Rank.
Nading moved, seconded by Loffredo, to deny waiver of experience
to Denise Jurca.
Odden moved, seconded by Rank, to approve Timeshare
Abbreviated Filings for Celebration World Resort (02-19-99),
Summer Bay Resort
(03-15-99), Fairfield Smoky Mountains at Governor’s Crossing
(03-18-99), Silverleaf’s Holiday Hills Resort (04-16-99),
and Painted Mountain Golf Villas (04-16-99); Timeshare Filing for
StoneBridge Village and Oakridge Condominiums (03-12-99); and Timeshare
Consolidated Filing for Sunrise Cove (04-16-99).
Elections for chair and vice chair were held with Rank nominating
Nading for chair, seconded by Odden and Nading nominating Rank
for vice chair, seconded by Loffredo. Motions carried unanimously.
Nading reported on ARELLO Board of Directors and committee meetings
regarding affinity programs and the bylaws committee.
Both Odden and Loffredo thanked the Commission for the experience
of serving on the committee.
Griebel reported on Senate File 404 recently passed
and on House File 472 currently under consideration. She also
reported on
the Governor’s rule-making task force.
Halvorson thanked Odden and Loffredo for their service; reported
that the legislature would likely end their session on April 30,
and updated the Commission on board vacancies and budget changes.
He also reported on the progress of electronic licensing capabilities.
Roger Hansen reported on the ARELLO Board of Directors and committee
meetings, particularly on task force ideas and information technology
related changes in real estate and regulation.
Griffel reported on the Commission sponsored Brokerage Management
Instructor Development Workshop on March 12 and on the UNI Advisory
Council meeting in Cedar Falls in April. UNI is seeking accreditation
for both a major and a minor in real estate.
Frank Hansen distributed an audit report and reported that most
brokers are doing a good job with their books.
Public comment:
Paul McLaughlin, IAR, reported on legislative issues, B and C
lenders, IL reciprocity changes, and upcoming IAR meetings.
Loffredo moved, seconded by Odden, to adjourn at 11:20 a.m. Motion
carried unanimously.
