The
meeting was called to order at 9:06 a.m.
Hughes
asked if anyone had objections to going out of order on the agenda
and no one objected.
543B.47(1),
(2), and (6) were discussed and changes were proposed. The changes
would eliminate the annual notice, permit compliance audits,
and clearly communicate the penalty for noncompliance.
543B.15(8)
was discussed. The change would eliminate waiver of salesperson
experience to qualify for broker based upon conditions existing
in the area where the person resides.
Proposed
new section 543B.48 “Civil Penalty” was discussed.
The new section would limit the amount of civil penalty that
could be assessed at $2500 per violation.
Hughes
moved, Leestamper seconded to approve the proposed amendments
to Iowa Code Chapter 543B, subsections 543B.47(1), (2), and (6),
543B.15(8), and new section 543B.48. Motion carried unanimously.
Leestamper
moved, seconded by Hughes to go into closed session pursuant
to Iowa Code 21.5 (1)(d) and Iowa Code 21.5 (1)(f). Roll call
vote was as follows: Miller, aye; Hughes, aye; Leestamper, aye.
Motion carried unanimously.
The
Commission entered into closed session at 9:45 a.m.
Leestamper
moved to go back into open session at 11:27 a.m. and Hughes seconded.
Motion carried unanimously.
Leestamper
moved, seconded by Hughes to accept the Informal Settlements
in cases 01-010 & 01-083. Roll call vote was as follows Hughes,
aye; Leestamper, aye; Miller, aye. Motion carried unanimously.
Leestamper
moved, seconded by Hughes to find probable cause in cases 01-044,
01-070, and 01-051. Roll call vote was as follows Hughes, aye;
Leestamper, aye; Miller, aye. Motion carried unanimously.
Hughes
moved, seconded by Leestamper to close the following cases: 01-052,
01-053, 01-050, 01-068, 01-059, 01-045, and 01-063, 01-036, 01-037,
01-049, 01-056, 01-054, and 01-067. Roll call vote was as follows
Hughes, aye; Leestamper, aye; Miller, aye. Motion carried unanimously.
Leestamper
moved, seconded by Hughes to approve the minutes of the August
8, 2001, meeting. Motion carried unanimously.
Hansen
reported that the Administrator was attending an important budget
meeting relating to concerns about the state’s revenue
shortfall and resulting impact on the division’s budget.
Future
meeting dates were discussed. Miller appointed Woline and Rank
to serve on the Investigative Committee meeting to be held on
Wednesday, October 24, 2001.
Paul
McLaughlin reported that the Iowa Association of Realtors State
Convention will be held in Davenport on September 25-28, 2001.
Hughes
moved, seconded by Leestamper to adjourn the meeting at 11:41
a.m. Motion carried unanimously.
