MINUTES--November
21, 2002
Present: James Hughes, Chair, Evelyn Rank, and
James O’Neill.
Absent: Dorothy Woline and Patty Daniels.

Present: Roger Hansen, Executive Officer, Pam Griebel,
Assistant Attorney General, and Susan Griffel, Education Director.
Bill Herman and Ben Wheeler, Peer Reviewers, joined the meeting
at 9:25 a.m.
The meeting was called to order at 9:06 a.m.
James O’Niell, new public member of the Commission
from Council Bluffs, was welcomed to the Commission.
The Commission reviewed and discussed Case No.
02-068, the salesperson application of Robert M. Young. Griebel
did not participate in
the discussion or provide legal advice because while she does
not remember the case, per Young, she must have represented him
in
when in private practice over ten years ago. Rank moved, second
by O’Neill to grant the license. Motion carried unanimously.
Rank moved, second by O’Neill to approve
the minutes for the October 3, 2002 meeting. Motion carried unanimously.
Meeting schedule was discussed and changed. The December 19, 2002
meeting was canceled. The January 30, 2003 was canceled and rescheduled
for January 16, 2003.
Hughes appointed Rank and Woline to serve as the Complaint Committee
for the January 15, 2003 meeting.
Griebel advised the Commission that oral arguments had been made
in the Franich decision that had been appealed to the district
court. She will update the Commission when the court has made a
determination.
Rank moved, second by O’Neill to go into closed session
at 9:28a.m. pursuant to Iowa Code 21.5(1)(d) and 21.5(1)(f). Roll
call vote as follows: Rank, aye; O’Niell, aye; Hughes, aye.
Motion carried unanimously.
The Commission entered into closed session at 9:28 a.m. and arose
therefrom at 11:01 a.m.
Rank moved, seconded by O’Neill to close
cases 01-070, 01-071, 01-096, 01-100, 01-103, 02-014, 02-028,
02-036, and 02-051. Motion
carried unanimously.
Rank moved seconded by O’Neill to find probable
cause in cases 02-093 (connecting to case 00-079) and 02-094
(connecting
to case 01-091). Motion carried unanimously.
Griebel presented a brief over view of confidentiality, the gift
law, and other relevant items. This was followed by an overview
of the investigation and disciplinary processes, including the
role of the Commission, Assistant Attorney General, Peer Reviewer,
and staff.
Griffel reported the office is busy because of renewals. She added
the contract for PSI is going to be reviewed to determine if the
contract is due to go out for bid in 2003.
Hansen reported the Iowa Department of Commerce, Insurance Division,
has approved the CNA Errors and Omissions Insurance Policy for
the Iowa Real Estate Commission Group Plan. Rice Insurance Services
is now marketing the plan in Iowa.
Hansen reported renewals have been mailed, marking the start of
the current renewal cycle. He encouraged all licensees to take
advantage of the ability to renew real licenses on online again
this year.
Paul McLaughlin, IAR, reported the winter meeting
of the Iowa Association of Realtors will be held in Des Moines,
December
10, 11, and 12, 2002. He provided additional information relating
to
RPAC and the association’s legislative committee interests.
Rank moved, second by O’Neill to adjourn
the meeting. Motion carried unanimously.
