MINUTES--April 18, 2002

Present: Robert Miller, Chair, James Hughes, Evelyn Rank, Dorothy Woline, and Barbara Leestamper

Others present: Roger Hansen, Executive Secretary, Pam Griebel, Assistant Attorney General, Kay Halloran, Division Administrator, and Susan Griffel, Education Director.

The meeting was called to order at 9:00 a.m.

Rank presented Miller with a plaque in appreciation for his service on the Commission.

Halloran presented Miller with a Certificate of Appreciation on behalf of the Professional Licensing Division for his service on the Commission.

Rank, Hughes, Leestamper, and Woline joined in recognizing Miller

Hughes moved, second by Rank to approve minutes of February 28, 2002 meeting. Motion carried unanimously.

Miller appointed Hughes and Woline to serve on the investigation committee for the June 05, 2002 meeting.

The Commission considered a request by Mark K. Brittain to waive the 24 month active salesperson experience to qualify for broker. Rank did not participate in the discussion. Based upon the information provided, Miller moved, second by Leestamper to deny the request. Roll call vote as follows: Hughes, aye; Miller, aye; Rank, abstained; Woline, aye; Leestamper, aye. Motion carried.

Hearing Complaint Case Number 01-060

Hughes moved, second by Rank to go into closed session pursuant to Iowa Code section 21.5(1)(d) and 21.5(1)(f) to deliberate. Miller, aye; Rank, aye; Woline, aye; Leestamper, aye and Hughes, aye. Motion carried.

Woline, aye; Leestamper, aye. Motion carried. The Commission entered into closed session at 10:02 a.m. and returned to open session at 10:20 a.m.

Rank moved second by Hughes to make public the finding of fact and decision in 01-060 and the revocation is public knowledge and effective when the written order etc. prepared. Roll call vote as follows: Miller, aye; Rank, aye; Woline, aye; Leestamper, aye and Hughes, aye. Motion carried.

Election of officers.

Miller nominated Hughes for Chair. Second, Woline. Roll call vote as follows: Miller, aye; Rank, aye; Woline, aye; Leestamper, aye. Hughes did not vote. Motion carried.

Hughes nominated Rank for Vice Chair. Second, Leestamper. Roll call vote as follows: Hughes, aye; Miller, aye; Woline, aye; Leestamper, aye. Rank did not vote. Motion carried.

Miller reported that serving on the commission has been a rewarding experience and thanked fellow Commissioners for their support.

Leestamper reported attending the UNI Advisory Board Meeting at the University of Northern Iowa.

Griffel reported work on the education rules has been completed.

Hansen reported work on IAC 193E is nearing completion and plans to have the rules ready for the Commission to approve at the next meeting in June.

Halloran reported that the division is consolidating administrative services as a cost saving measure to reduce duplication of services.

Public Comment. Paul McLaughlin, IAR, reported that the next IAR meeting is scheduled for June 10, 11, and 12, 2002 in Des Moines. He also reported on IAR sponsored legislation that passed the last session of the legislature.

Hughes moved, second by Rank to go into closed session pursuant to Iowa Code section 21.5(1)(d) and 21.5(1)(f) to deliberate. Hughes, aye; Miller, aye; Rank, aye; Woline, aye; Leestamper, aye. Motion carried. The Commission entered into closed session at 4: 20 p.m. and returned to open session at 4:45 p.m.

Rank moved, second by Hughes go into closed session pursuant to Iowa Code 21.5(1)(d) and 21.5(1)(f). to review complaint cases. Roll call vote as follows: Hughes, aye; Miller, aye; Rank, aye; Woline, aye; Leestamper, aye. Motion carried. The Commission entered into closed session at 4: 47 p.m. and returned to open session at 5:02 p.m.

Rank moved, second by Hughes to find probable cause in the following complaint cases: 02-010, 01-095, 01-098, 02-006 (renumbered 02-56), and 02-021. Roll call vote as follows: Hughes, aye; Miller, aye; Rank, aye; Woline, aye; Leestamper, aye. Motion carried.

Hughes moved, second by Woline to close the following complaint cases:

02-006a, 02-007, 02-008, 02-012, 02-014, 02-015, and 01-099. Roll call vote as follows: Hughes, aye; Miller, aye; Rank, aye; Woline, aye; Leestamper, aye. Motion carried.

Miller moved, second by Rank to adjourn. Motion carried unanimously.
