Meeting Conducted by Telephone Conference Call
MINUTES
Commissioner and Administrative Law Judge participation was conducted via telephone
conference call because it was not practical or economically feasible to personally attend
a meeting for the limited agenda.
Present on Telephone: Laurie Dawley, Vice Chair; Patty Daniels; James O'Neill, Dan
Berry, Lori Diehl and Donald Marple.
Not Present: James Hughes
Others Present on Telephone: Judge Margaret LaMarche, ALJ
Others Present in Person: Roger Hansen, Executive Officer; Dave Batts, Compliance
Officer and Sylvia King, Staff
The meeting was called to order at 2:34 p.m.
CLOSED SESSION
Motion made by Berry, second O'Neill, to enter into closed session pursuant to Iowa
Code 21.5(1)(a) and 21.5(1)(f) to discuss the applications for continuance of pre-hearing
conference and hearing in Cases 04-164 and 06-009. Roll call vote as follows: Daniels,
aye; O'Neill, aye; Dawley, aye; Marple, aye; Diehl, aye and Berry, aye. Commission entered
into closed session at 2:36 p.m. and returned to open session at 3:02 p.m. Once in open
session, Berry moved, second O'Neill, directing Judge LaMarche to draft an Order denying
the motion for continuance in accordance with the factors discussed in closed session.
Motion carried unanimously.
MEETING ADJOURNED
Motion made by Berry, second O'Neill, to adjourn. Motion carried unanimously. Meeting
adjourned at 3:02 p.m.
