The meeting was called to order at 9:03 a.m. by Chair Hughes.
PETITION FOR DECLATORY ORDER D07-01
Motion made by Daniels, second by O’Neill to approve the Petition for
Declaratory Order D07-01. Motion carried unanimously.
MINUTES
Motion made by O’Neil, seconded by Diehl, to approve the October 11,
2007 minutes as amended. Motion carried unanimously.

COMMISSIONER REPORTS
Hughes reported that he and Hansen were on the program for the Iowa
Association of Realtors Leadership Meeting. The session was well
attended and they answered numerous questions.
ASSISTANT ATTORNEY GENERAL REPORT
Lundquist reported on the Fazio case. On 10/29/07 Fazio’s petition
for writ of certiorari challenging his criminal convictions was denied
by the United States Supreme Court. Consequently, there are no more
direct appeals of his conviction left. Fazio’s appeal of the
Commission’s revocation of his real estate license remains pending
before the Iowa Supreme Court.
STAFF REPORTS
Klisares reported on line renewal went live on November 7th and 400
renewals have been completed as of today’s date.
Griffel reported the newsletter will be going out late December and a
renewal reminder will be included in the issue.
Hansen received an informative DVD on Mortgage Fraud and played it
for the Commission Board Members and staff before adjourning.
CLOSED SESSION
Motion made by Dawley, seconded by O’Neill, to enter into closed
session pursuant to Iowa Code 21.5(1)(d) and 21.5(1)(f) to discuss
informal settlements, consent agreements/orders or Consent Orders. Roll
call as follows: Hughes, aye; Dawley, aye; Diehl, aye; O’Neill, aye;
Stevens, aye; and Daniels, aye. Motion carried unanimously.
The Commission entered into closed session at 9:24 a.m. and arose
therefrom at
10:13 a.m.
OPEN SESSION
Motion made by Dawley, second by Daniels to accept signed settlements
and/or consent agreements, cease and desist or consent order for cases
07-186; 07-184; 07-177; 07-214; 07-171; 07-187; 07-160; 07-195; 07-205;
07-188; 07-197; 07-192 and 07-199. Motion carried unanimously.
Motion made by Dawley, second by O’Neill to find probable cause on
the following cases: 07-193; 07-218; 07-224; 07-225; 07-233; 07-248;
07-229; 07-230; 07-231; 07-232; 07-236; 07-239; 07-250; 07-190; 07-232;
A07-023 and A07-025. Motion carried unanimously.
Motion made by Dawley, second by Diehl to close the following cases:
